International students can work in US after graduation

After graduation, international students with an F-1 visa can now work in US for one year through the Optional Practical Training (OPT) program. On the other hand, the program allows a few students with a major in any of the STEM subjects can stay back in the USA for two more years.

Optional Practical Training (OPT) program

Under the OPT program, international students can start working in the US after finishing their graduation or while they are still studying. Additionally, this program allows graduate and undergraduate international students to begin their entrepreneurial careers before or after getting the degree.

After the OPT or STEM OPT expires, students will only be left with 60 days to leave the country.

Work Visas for International Students

In case you want to stay in the US after your OPT expires or don’t qualify for the program, you will need a work visa. There most common work visas are H-1B Visa, E-2 Visa, TN Visa, and O-1A Visa.

H-1B Visa – This is the most common temporary work visa in the country. Here, the selection is made through a lottery system, and about 65,000 visas are allotted to the graduates. In comparison, about 20,000 visas are allocated to the post-graduates. The visa is valid for six years, with the possibility to apply for a US PR.

E-2 Visa – The visa is for student entrepreneurs who are from a treaty country. These student entrepreneurs must invest a certain amount of funds in their company and hold not less than a 50% stake in order to qualify for the visa. The visa applicants need not hold any minimum degree. An E-2 visa can be extended as long as the business is viable and operational.

TN Visa – This visa works well for students belonging to Canada or Mexico. TN Visa is only for a few occupations, including engineering, nursing, other medical professions, teaching, etc. Applicants for this visa must at least have completed a bachelor’s degree. The process of applying for a PR under the TN visa is a little challenging and complex.

O-1A Visa – This is a temporary work visa for students having extraordinary skills in the field of education, science, business, arts, and athletics. An O-1A visa allows indefinite extensions and an option to apply for US PR.

U.S. PR Visas for International Students

International students looking for PR visas in the USA can apply for only two types of visas: EB-2 NIW visa and EB-1A visa.

EB-2 NIW visa – EB-2 National Interest Waiver (NIW) is a petition for permanent immigration in the USA. In order to qualify for the visa, one must have an exceptional ability or advanced level of education. The green card processing time under this visa takes up to a year.

EB-1A visa – Applying for a US PR through the EB-1A visa pathway is the toughest, as you must demonstrate that you lie in the 1% in your area of expertise. The green card processing time with this visa is less than a year.
