Abstract: Canada plans to reduce the processing time of LMIA from 21 days to 10 days.

Canada operates the TFWP or Temporary Foreign Worker Program through IRCC or Immigration, Refugees, and Citizenship Canada. It helps Canadian employers address labor and skills shortages in their organizations when no qualified Canadians or permanent residents are available.

Canadian employers hiring international professionals under this program are required to complete the LMIA or Labor Market Impact Assessment. It is done to demonstrate that recruitment will either have a positive or neutral effect on the job market in Canada.

Earlier, the LMIAs were processed in approximately 21 business days across the 7 streams authorized by the IRCC. The streams include:

  • Global Talent Stream
  • Permanent Residence stream
  • Agricultural stream
  • High-wage stream
  • Low-wage stream
  • Seasonal Agricultural Worker Program
  • In-home caregivers stream

To address the shortage in the workforce, IRCC has announced the reduction of the processing time of the LMIA to 10 business days.

Despite the speedy processing time, the employers who are categorized in the abovementioned stream must fulfill the program requirements needed to assess the TFWP applications

The 10 business day processing period is available for Canadian employers hiring international professionals in the skilled trades listed below:

  • Deemed essential for infrastructural development
  • Natural resource extraction

The professionals have an income at or more than the median income in the province or territory where they work.

The expedited processing for LMIA is available for Canadian employers offering international professionals an income that meets or is more than the top 10% of income earned by citizens or international individuals having Canada PR visa in a particular province or territory of Canada. Temporary foreign workers under this category are highly skilled in their professions, with skills rarely found in the Canadian workforce.

LMIAs for international professionals employed for short duration

The 10 business-day LMIA processing is available for Canadian employers who hire international professionals for not more than 120 days. The income offered to the international professionals in these cases must be the same or more than the provincial or territorial average in the place where the job is located.
