Major Australian visas for foreign investors

Subclass 188 – Business Innovation and Investment (Provisional) visa

This Australia investor visa type is for you if you are interested in ownership and management of a business in Australia. It’s for you if you want to do business and investment in Australia or take up an entrepreneurial activity in Australia.

There are several streams involved in this visa.

Business Innovation Stream

If you have business skills this stream helps you to operate an existing/new business in Australia. Under this stream, you can stay in Australia for up to 5 years.

Holding a visa under this stream, you can apply for a Subclass 888 visa in this same stream.

Eligibility criteria

  • Get a minimum score of 65 on the points test
  • Give proof of your success doing business (E.g., ownership interest, annual turnover)
  • Proof showing a minimum total net business and personal assets that you, your partner, or you both together have:
    • 25 million if an ITA was issued to you for this visa on or after July 1, 2021
    • AUD800,000 if an ITA was issued to you to apply for this visa before July 1, 2021

Investor Stream

To qualify to apply for the visa under this stream, it’s necessary that you make a minimum investment of AUD2.5 million in Australian investments. These investments have to meet certain requirements. They also have to maintain investment or business activity in Australia.

Here too, you can stay in Australia for up to 5 years.

Note:

  • You have to make an investment of AUD1.5 million in a state/territory in Australia.
  • You have to receive a nomination by the government agency of a state/territory in Australia.

Significant Investor Stream

It’s a provisional visa. You have to make a minimum investment of AUD5 million in Australian investments. These investments have to meet certain requirements. They also have to maintain investment or business activity in Australia.

Note:

  • You have to make an investment of AUD5 million with full compliance with significant investments in Australia.
  • You have to receive a nomination by the government agency of a state/territory in Australia or Austrade.

Business Innovation Extension stream

If you already hold a Subclass 188 visa, under this stream you can extend your stay in Australia. You can stay in Australia for up to 6, 7, or 8 years counted from the date you were granted the original Subclass 188 visa in the Business Innovation stream.

Note:

  • Extend your stay in Australia for not more than 2 years.
  • You have to hold a Subclass 188 visa in the Business Innovation stream for a minimum of 3 years.
  • You must have held only one Subclass 188 visa.
  • You have to be nominated by the government agency of a state/territory of Australia.

Significant Investor Extension stream

If you already hold a Subclass 188 visa, under this stream you can extend your stay in Australia. You can stay in Australia for up to 4 years counted from the date you were granted the original Subclass 188 visa in the Significant Investor Stream.

Note:

  • Extend your stay in Australia for not more than 4 years.
  • You must hold a Subclass 188 visa in the Significant Investor stream for a minimum of 3 years.
  • You must have held only one Subclass 188 visa.
  • You have to be nominated by the government agency of a state/territory of Australia.

Premium Investor stream

This is a provisional visa. It’s meant for individuals nominated by Austrade. They must have made a minimum investment of AUD15 million in Australian investments and/or philanthropic contributions.

Under this stream, you can stay for up to 4 years and 3 months.

Note:

  • You have to make an investment of AUD15 million in Australian investments and/or philanthropic contributions. They have to meet certain requirements.
  • You must receive a nomination from Austrade.

Entrepreneur stream

Entrepreneurs must meet the following criteria:

  • They must be in the startup and early stages of entrepreneurship.
  • They must have received an endorsement to develop their concepts.
  • They must have received a nomination from the government agency of a state/territory of Australia.

Under this stream, they can stay up to 5 years in Australia.

  • You must first receive a nomination from a government agency in a state/territory of Australia.
  • You must have a funding agreement with a third party for entrepreneurial activities.

Subclass 891 – Investor Visa

The Subclass 891 visa is meant for those who take up investment and business activities in Australia. You can stay indefinitely in Australia with this visa. It’s necessary that you possess a qualifying visa granted to you on a particular basis in order to apply as a primary applicant for this visa.

To be eligible for this visa, you must:

  • hold of a Subclass 162 visa
  • have lived in Australia for 2 of the past 4 years
  • have held a designated investment of AUD1.5 million for a period of 4 years

Holding this visa, you can

  • stay permanently in Australia
  • lodge an application for Australian citizenship (if you have the eligibility)
  • continue your business and investment activity in Australia
