Spain has decided to recognize Britons who are staying back in the country even after the UK’s separation from the EU as its legal residents. The residence permits will be issued to the Britons willing to stay on in Spain.

The agreement regarding this was signed on July 4, 2020.

The document of instruction acts as a guideline to the procedure for issuing the residence document. It's as provided for in Article 18.4 of the Withdrawal Agreement of the UK from the EU.

As of today, Spain is home to the largest number of British nationals among the EU member states. Data as of December 31, 2019, says that there were 359,471 UK nationals registered as residents in Spain.

This has led the Spanish government to distinguish between those with a family card or registration certificate of an EU citizen from those without them for valid reasons.

The Instruction document specifies that any relative of the UK nationals benefitting from an Agreement and those who are from a third country are also beneficiaries of the agreement. This makes them eligible to apply for this document.

The family cards and registration certificates of EU citizens they got before the end of the period of transition will remain valid.
