Offshore Partner Visa Subclass 309 and 100

With the Partner Visa Subclass 309 and 100, a visa of Australia, partners or de facto partners of Australian citizens, permanent residents, or New Zealand citizens can visit and stay in the ‘Land Down Under.’ 

The subclass 100 visa is granted to holders of temporary partner visa, or subclass 309 visa. Visa 100 allows you to live in Australia indefinitely. After a certain period, you are allowed to also apply for Australian citizenship in case you meet the requirements of the eligibility clauses that the authority states under Visa 100.

Individuals holding a subclass 309 temporary visas are allowed to apply for Visa 100 if they intend to become Australia’s permanent residents permanently. It will allow them to also enroll in several healthcare facilities during their stay in Australia. 

 They are also allowed to enroll in education programs to study in Australia. Subclass 309 visa holders can travel to and from Australia as many times as they wish, while subclass 100 visa holders can travel unrestrictedly for the first five years. To apply to re-enter Australia after this period, they must apply for Resident Reserve (RRV).

Eligibility to Apply for Australia Partner Visa 309 & 100

Both the partner visa 309 and subclass 100 comprise particular clauses that need to be met before individuals apply for the 309 visa application as stated below:

  • You must apply for Subclass 309 from outside of Australia.
  • You must actually be in a relationship with an individual who is an Australian permanent resident, its citizen, or a New Zealand citizen.
  • You can apply for the subclass 100 visa as long as you are a Subclass 309 visa holder.

Health and Character Requirements

If you want to get the visa, the requirements of health and character stated by the Australian government must be met. Applicants having a de facto bond need to be aged a minimum of 18.

Details of Sponsorship 

Applicants must have sponsorship that will be accepted by the government of Australia. The individual sponsoring you should also sponsor you for a minimum of two years after the issuance of subclass 309.

The application is evaluated two years after the visa application has been lodged. The documents must be sent one month before the date of two years after sending the application.

Conditions for Both Visa Subclass 100 and 309 Visa

After the submission of the application, ask if the authority requires any additional details. If yes, submit them at the earliest.

  • In case the application is accepted, you get the information about it.
  • If the application is declined, you will know why it wasn’t accepted.
  • In case the visa gets declined, the fee for processing will not be returned.
