Details of the new initiative:

As of Jan 1, 2024, employers must update the wages of temporary foreign workers to reflect changes to their salaries. The application of TFWP should be made according to the latest wage requirements.

 

The wages of Bankers are updated every year by fall. Before hiring a Temporary foreign worker under the Canadian immigration rules, the employers will need an LMIA confirming that no other worker or Canadian or permanent resident is available to do this job.

 

Three kinds of jobs exempt from LMIA requirements:

The three kinds of jobs that are excluded from LMIA requirements:

 

  • Jobs that are included in an international trade accord
  • Jobs that are included in an agreement between the federal government and a provincial/territorial government,
  • Those deemed in the best interests of Canada.

Canada is protecting Temporary Foreign Workers Rights:

Provinces and territories ensure to play a critical role in immigration, which is responsive to employers' labor needs and benefits all regions of the country. So, its provinces and territories' duty is to protect the foreign worker's rights. To hire temporary foreign workers, the employer must follow the following:

 

  • Provide them with information about their rights;
  • Provide them signed copies of their employment agreements on or before their first day of work;
  • Pay them for their work as stated in the employment agreement, including overtime work;
  • Make reasonable efforts to provide them with a workplace free of abuse, including reprisals;
  • Follow the employment and recruitment standards of the province or territory where they work;
  • Get and pay for private health insurance that covers their emergency medical care until they are eligible for provincial or territorial health insurance coverage;
  • Make reasonable efforts to give them access to healthcare services if they are injured or become ill at work.

 

Employers are not allowed to:

 

  • Force temporary foreign workers to perform unsafe work
  • Pressuring them to work over-time which is not included in their agreement
  • Force them to work even when they are sick
  • Punish them unnecessarily
  • Take their passport and work permit away from them
  • Change the employer's immigration status
  • Make them pay before the employment
