Adelaide Court cancels Immigration decision for detention

The Adelaide Court has canceled an immigration decision for the detention of a father who was branded as a biker and banished from Australia. He has thus won the battle in the court against Department of Home Affairs and is now authorized to remain in Australia.

Paul Burgess was stripped of his Australia PR by the then Immigration Minister Peter Dutton in 2016 June. It was a part of a national sting targeting overseas citizens with records of crime. He is the father of a child and has spent 20 months in migration detention centers at Christmas Island and Perth.

Paul Burgess was faced with deportation to the UK, the nation where he has not returned since he was just a 2 years kid.

The Adelaide Federal Court overturned the decision of the Immigration Minister. It ordered that the 33 years old father must be released with immediate effect, as quoted by the 9 News Com AU.

Megan Ferris the fiancée of Paul Burgess said that she was overwhelmed with joy after the victory in the long drawn battle in the court. She said that they are scheduled to get married in a week once Paul returns home. Ferris also hopes that Paul will be able to join her for the birthday celebrations of their 6 years old son Hunter.

In the original case, Dutton relied on two months spent by Paul as a member of a biker gang 5 years ago. He then abandoned this in the second appeal and relied on petty offenses for denial of PR. This was revealed by Mitchell Simmons the advocate for Paul Burgess.
