Eight categories to Study in Canada without a study permit:

If a Foreign national falls within any of these eight categories, then they can study in Canada without a study permit:

 

  • Students enrolled in short-time study program:

Foreign students who want to study in Canada for post-secondary education for six months or for a shorter period of time don’t need a study permit. 

 

  • Members of  foreign representatives:

Individuals or members who are a part of GAC (Global Affairs Canada) as foreign representatives do not need a study visa in Canada.

 

  • Members of foreign armed forces of a country under the Visiting Forces Act:

Canadian foreign armed forces member does not need a study permit in Canada. This applies to individuals designated civilian personnel appointed in the military for armed forces or under Canada’s Visiting Force Act (VFA). 

 

  • Registered country citizens in Canada: 

Immigrants in Canada with citizenship from another country can study in Canada without a study permit. 

 

A registered status and citizenship are not similar; being a registered citizen of Canada means having a status as an indigenous person in Canada.

 

  • Minor children in Canada:

Here are the following scenarios through which minor children can pursue or doesn’t need a study permit in Canada:

 

  • If the child is a refugee or refugee claim
  • Parents of minor children are refugees or refugee claimants
  • Minor child parents are a Canadian Citizenship
  • If the child is in school.

Temporary Residents and asylum seekers taking French language and culture courses:           

Asylum seekers or Temporary resident in Canada does not require a study permit to learn French and other cultural integration courses in Quebec.

 

Workers who are allowed to study without a study visa:

 

International workers who are in Canada are allowed to study in Canada without a permit if:

 

  • A valid work permit that was granted on or before June 7, 2023
  • Have a letter that is granted on or before June 7, 2023, which will authorize them to work

 

Advantages of appealing for a study permit and acquiring a study permit:

Foreign nationals have opportunities to be educated in Canada does not need to apply for study visa, if:

 

Minor Children in Canada:

As per IRCC, minor children in Canada with valid study permits have many opportunities to opt for:

 

  • Secondary school co-op work permits
  • Get the opportunity to be a part of Social Services in territories
  • Can change between education levels without changing permits or applying for a new one.

 

Point to note: A minor child who wants to go on be educated in Canada must apply for a study permit after they are18-19 years old, depending on the place they decide.

 

Working student study permit benefits:

This benefit is only for enrolled full-time students with a permit at DLI. According to the license conditions, these students may work in campus.

Applicants who do not have a study visa cannot work during their Canadian study program and must register for a Canada work visa.

Detail of how NOC impact on Canada PR

Nora is a software developer who received a NOI (Notification of Interest) from OINP under a tech draw. He submitted his EOI (Expression of Interest) to the federal Express Entry Pool. After evaluating the applicant’s profile through the provincial government in the Express Entry Federal pool, he will be issued an NOI through an Enhanced PNF.

 

The NOI got issued to Nora as he met the Ontario tech draw’s requirements, with the  primary NOC code from the list of Ontario target occupations. Nora can submit his provincial application with the Ontario government.

 

For doing that, Nora must submit required documents to the Ontario government, such as reference letters, as well as the NOC code he asked for.  

 

Each employer will provide reference letters, allowing the province to confirm that the NOC assesses his job duties and responsibilities, pointing to his federal Express Entry profile.

Things to do if NOC changes during the PR application

The provided documents can be used to verify that the candidates' job roles and responsibilities with an NOC on the province/territory's targeted occupation list.

 

Here are some situations to understand the scenario better:

 

 Situation 1: Nora claimed that his job profile is linked with (Software Developers and Programmers) NOC 21232 on his application. The Ontario government has assessed the job more closely associated with NOC 21234 – Web Developers and Programmers.

 

In the 1st situation, though Nora's job doesn't match the stated NOC, the application may be acted on because his aligned NOC is still on the Ontario government's list of the targeted occupations for tech draws. The OINP will reach out to the person for clarification.

 

Situation 2: Even after claiming NOC 21232 (Software Developers Programmers) on his application, the Ontario government assessed that his job was more aligned with NOC 22220- Computer Network and Web Technicians.

 

In the 2nd situation, as Nora's assigned NOC is not on Ontario's targeted occupations list, Nora will not be accepted for a provincial nomination through the OINP and will be rejected.

Issues aligned with different NOCs

Applicants who notice their primary NOC was changed and are not listed as a targeted NOC before submitting their NOC can step back with their application, as it would be either refused or non-acceptable.

 

Applicants who submit their application after learning its state can try to take it back, but they will likely lose the payment they made for their provincial application.

Issues that can change NOCs at the Federal level

A change in NOC after receiving the Ontario nomination might affect a candidate’s Permanent residency application with the federal government.

 

The candidate must have the same NOC-specific provincial nomination as the primary occupation for which they initially applied to the province.

 

If the applicant changes the NOC code at the final stage, they might get refused because they do not qualify within the criteria for the provincial nomination.

Details of the September work policy

Ottawa is offering the liberty to international students who can work off-campus for up to 24 hours a week starting in September. It is temporarily waived to 20- a 20-hour cap on work hours for international students.

 

The purpose of the international student program is to allow international students to work. The government noticed that 80 percent of students are currently working more than 20 hours a week.  

 

The work hour’s limit will remain 20 hours per week until September when the government can implement a permanent change to make it 24 hours.
