Norway has made its decisions on reopening its borders to EEA and Schengen countries. The latest word from the country is that it intends to reopen its borders to EEA and Schengen countries from July 15, 2020.

The European Commission had suggested reopening borders on June 15, 2020. But Norway delayed it by a month. This was because it wanted to be sure that the nations they let travelers from are safe enough in the present scenario with the risk of spreading the COVID pandemic.

The criteria Norway uses to measure the safety of countries they open up to are:

  • Trace systems and information for people traveling
  • The number of tests done
  • The ratio of positive tests with the overall number of tests
  • The number of people admitted to intensive care recently
  • The proportion of new COVID-19 cases with the size of the population

Any person with a Norway visit visa from the countries Norway finds safe will be exempt from measures like quarantine. But once those countries show any sign of a resurgence of infections, the restrictive measures will be reinstated for them.

After July 15, 2020, Norwegians will no more be barred from traveling to the Schengen area and EU countries as with a visitor visa. Nevertheless, the country presses on the point that such removal of advice for travel does not mean an encouragement to travel.

Visa cancellation is a pretty serious issue in any country. The visa holder has to go ahead with steps to ensure that his/her stay in the country is not treated illegal, inviting penalty, and even imprisonment.

In immigration Australia, there are ways to deal with the situation where visa cancellation becomes an issue. The first thing to remember is that without a valid visa, one becomes an unlawful citizen in the country.

When a visa is due to be canceled, you get a notice from the Department of Home Affairs. This Notice of Intention to Consider Cancellation of visa opens an opportunity for you to get legal consultation at the earliest. The deadline for seeking legal advice can be as short as 2 days, which creates an urgency that should not be missed.

One instance of visa cancellation is due to incorrect information given during application like citizenship application. If you are involved in such a case, there is always a legal provision to explain any genuine reasons for missing documents or details verified suspicious or wrong.

Another way in which visas may be canceled automatically is when one is sentenced to 12 months or more of imprisonment. In such a case, reapplying for a visa directly to the Minister of Immigration could be done. Until the reapplication is decided on, the applicant will be under immigration detention.

This is in case the visa has been canceled or denied under Section 501 of the Migration Act.

Another avenue to seek a judicial review is at the Federal Circuit Court. You can seek whether there was a legal mistake in how the decision to cancel your visa was made at the AAT.

The fact is that when the applicants appear before the AAT with legal representation, their success rate in winning the case increases about 7 times.

One way of staying in Australia is to apply for a bridging visa before one’s original visa expires.

These days when COVID-19 crisis making it impossible to go out of national boundaries, such instances as lack of flights to one’s home country could be cited as a genuine argument in challenging visa cancellation cases.

Australia is also helping by providing a one-off payment of about $400 per family of those who came to work in Australia and has lost jobs as casual workers. The help goes to international students too who are struggling as their visas are nearing expiry.

Canada immigration has shown exemplary performance in the first half of 2020. Every method of immigration draw has been exercised and a commendable number of beneficiaries have been created.

In the first half of this year, Canada conducted the smallest and the largest Express Entry draws ever. This had an influence from the COVID-19 pandemic’s spread that put world nations on alert.

The biggest Express Entry draw conducted by Immigration, Refugees and Citizenship Canada (IRCC) invited 4,900 candidates in one draw. This immigration Canada draw happened on February 19, 2020.

Then, on March 12, an announcement was made by Marco Mendicino, the new immigration minister, that Canada will bring in more than 1 million immigrants by 2022. Many of these immigrants will find their way to Canada via Express Entry.

It was on March 18, that Canada imposed border closure and restrictions on travel to fight rising COVID-19 infections. This was the most challenging situation faced by Canada immigration.

But a resilient Canada kept on with its tasks for immigration, focused on achieving its immigration goals. This was mainly because immigration was the most important aspect of the economic recovery of Canada.

Certain drastic changes were implemented in immigration. The all-program draws that used to be conducted once every 2 weeks, began to be conducted within days or even hours. The draws involved candidates from the streams of:

  • Canadian Experience Class (CEC)
  • Federal Skilled Trades Program (FSTP)
  • Foreign Skilled Worker Program (FSWP)

These draws would aim for Provincial Nominee Program (PNP) in one draw and CEC candidates in another.

Till now, 21 such draws have been held which is almost double of what had happened in 2019 in the same time period.

Also, this year till now, 49,900 Invitations to Apply (ITA) have been issued this year. Last year, this number was 41,800 in the first half of the year.

Considering PNP draws, the lowest Comprehensive Ranking System (CRS) score requirement was 692 this year. This draw was conducted on April 29, 2020.

The smallest Express Entry draw to ever be conducted was held on April 15, 2020. It invited 118 candidates. The same draw had the largest CRS cutoff score of 2020, 808.

There has been much happening with Express Entry-linked PNP draws too. Alberta held 11 Alberta Express Entry Stream draws. Of these, 6 were conducted after March 18, when the restrictions were imposed.

British Columbia still conducts weekly draws even while being plagued by closure of businesses leading to exclusion of certain job categories from the draws. The selected candidates came both from Skills Immigration and Express Entry BC categories.

Manitoba had its first PNP draw this year on January 2. The total number of draws this year till now comes to 12. 7 of these were held after the border closures due to COVID-19.

Nova Scotia held its first PNP draw on January 2. This one invited candidates with proficiency in French and English. The second draw aimed at candidates with nursing experience.

Ontario has conducted 8 draws participating Express Entry candidates. Most of these draws were held when border restrictions were in force. The province conducted 2 Express Entry draws and 2 Tech Pilot draws. There were also invitation rounds for candidates eligible for Express Entry Skilled Trades and French-Speaking Skilled Worker streams.

Prince Edward Island (PEI) conducted Express Entry draws that targeted Express Entry candidates who were workers in essential services such as trucking and healthcare.

Saskatchewan held 5 Express Entry-linked draws so far in 2020. The province has also given flexibility for applicants regarding submitting completed applications. This is considering the disruptions caused by COVID-19.

Spain has declared that it will allow many countries beyond the Schengen zone and European Union to enter its borders from June 30, 2020.

These countries will be accepted owing to the lower COVID-19 infection rates they have currently. Spain has announced that regular routes will be reinstated with countries that are known to keep COVID-19 infection under control.

The countries to which Spain has opened its borders already includes all EU countries and Schengen nations and the UK. Nationals from these countries are already permitted in Spain with their Spain tourist visa.

The only country that has been an exception to the new decision is Portugal. The land borders to Portugal will open on July 1, 2020, when Spain will also open borders to Morocco.

On June 21, 2020, 100 passenger aircrafts arrived in Spain as it had reopened its borders to the Schengen zone and the EU countries.

Spain is in great need to revive its tourism industry, which contributes a major share to the country’s total earnings. As the COVID-19 crisis has hit this sector badly, the country has allocated over €4.2 billion to bring back this sector on track.

France will now issue provisional residence permits to such travelers. This will let them stay legally in France, in case their Schengen visas have gone beyond expiry date.

For travelers with a Schengen tourist visa nearing its expiry, France will grant extended visa validity for a maximum of 90 days.

All the travelers who reached France before March 17, 2020, and couldn’t leave the country due to travel restrictions, will benefit from this decision.

To put it in another way, every third-country national who’s unable to go out of France for valid reasons will be granted provisional residence permits or extension of a travel visa.

France also considers those who hold

  • French residence permits,
  • receipts for renewal applications of residence permits that expire between March 16 and May 15, 2020, and
  • long-stay visas

stuck in places out of France due to flight cancellations. They will be allowed to return to France at the earliest when the situation permits.

Those with a Schengen visitor visa for brief stays, who have traveled to France before the pandemic, and now stranded there, can apply for a fresh visa undergoing a simpler procedure needing lesser documentation.

In a fresh round of invitations issued to eligible Express Entry (EE) candidates on June 24, 2020, candidates with provincial nominations were invited.

Immigration, Refugees and Citizenship Canada (IRCC) invited 382 candidates in this round. These candidates had a Comprehensive Ranking System (CRS) score of 696 or more.

The minimum CRS score was a result of the basic score (96) and 600 extra points awarded upon their receiving provincial nomination. The CRS score is given based on human capital factors like work experience, education, age, and language proficiency. The higher the score, the better the chance to get nominated.

It is through the Express Entry system that skilled foreign workers arrive to work in Canada. The Express Entry system manages the profiles of candidates for the streams of:

  • Canadian Experience Class (CEC)
  • Federal Skilled Trades Class
  • Federal Skilled Worker Class

A tie-break rule was used in this round of invitation. Every candidate with a minimum CRS score of 696 and had submitted the profile before 23 April 2020, at 10:39:30 UTC, got an ITA in this round.

Since the COVID-19 prevention measures and travel restrictions were imposed in Canada after March 18, 2020, immigration Canada has been conducting Express Entry draws regularly. They aimed at CEC candidates and provincial nominees.

The concerted effort in Canada immigration has kept the country on track in achieving the projected immigration targets. Till now, 46,392 principal applicants received invitations to apply for a permanent residence this year.

An impressive performance on the Express Entry-linked provincial nominee streams has been delivered. Canadian provinces have contacted over 1000 EE candidates to apply for a provincial nomination in the past week itself.

British Columbia holds new tech draw, welcomes 87 techies

BC PNP Draw

British Columbia (BC) held its most recent tech pilot on 23 June 2020. It invited 87 tech skilled candidates holding job offers in technology enterprises in BC to apply for permanent residence.

In this draw, British Columbia Provincial Nominee Program (BC PNP) sent invitations to candidates under the Express Entry BC and Skills Immigration categories.

Those candidates who are chosen from the Skilled Worker and International Graduate sub-categories needed a score of at least 80 points.

The BC PNP Tech Pilot creates a pathway for immigration on a fast-track mode for tech workers who are in high demand. It also serves as a pathway for international students.

The extension to the BC PNP Tech Pilot project done lately is applicable until June 2021.

To be eligible to take part in this immigration program, candidates need to register themselves in one of the BC’s current immigration streams at the provincial level. The province should also give a job offer that’s valid for at least a year. This occupation must be part of the list of 29 jobs deemed eligible by Tech Pilot.

The candidates in this draw need to make a profile via BC PNP’s online portal. They then have to register with the SIRS (Skills Immigration Registration System).

These profiles are given scores based on factors like:

  • English language proficiency
  • employment location
  • education level
  • age
  • work experience

Candidates who are nominated from BC will be granted an extra 600 points on their original CRS (Comprehensive Ranking System) score. This will in effect make sure that the candidate gets an ITA (Invitation to Apply) in an upcoming Express Entry draw.

The invited candidates have to apply for nomination under 30 days.

Germany has issued an ordinance that helps those with expired Schengen visas to stay longer in the country. The ordinance allows such people who are stuck within the borders of Germany due to COVID-19 prevention measures. They can stay on in Germany till September 30, 2020, without needing to hold a residence permit.

This ordinance that concerns Germany migration is applicable to all foreigners who:

  • Who were in Germany’s federal territory on 17 March 2020, holding a valid Schengen visa, or
  • Who entered Germany’s federal territory not before 17 March 2020, and stayed in Germany until 30 June 2020.

Germany’s Ministry of Interior has even decided to allow these people to get a job in Germany during their stay. The jobs they may find could be one that is not treated as employment under the definition by the Residence Act.

These people will be allowed to travel to another country that offers them entry. But this will be subject to the condition that Germany allows those arriving from that country to enter inside its borders again, letting them stay for up to 3 days until September 30, 2020.

The current ordinance follows an earlier one that had allowed stay till June 30, 2020.

The decision has finally been made by the US President Donald Trump. Employment-based immigration to the US has been suspended from June 24, 2020 till December 31, 2020.

The executive order by the President of the US will come into effect from June 24, 2020. New visas for US immigration will not be issued in the following categories:

  • H-1B– It’s a non-immigrant visa. It’s used by US companies to hire graduate workers from abroad. They employed the workers in specialty occupations requiring expertise and specialization.
  • H-2B– A visa for temporary workers who do not work in USA for the agriculture industry. The businesses in the US will hire these temporary workers to fill the deficiency of native workers and keep the business running.
  • J visas– J visas, or Exchange visitor visas, are non-immigrant visas for people approved to participate in exchange visitor programs in the US.
  • L visas– This type of visas is a work visa that’s available to those who are in managerial positions and have specialized knowledge and are subject to temporary intracompany transfer.

The new presidential order applies to those outside the US, and not holding a US work visa. The order however maintains the clause that the US government can exempt certain people from the suspension. People seeking asylum in the US will also not be subject to the order.

The state of affairs with the US now has prompted prospective migrants to shift their focus to the next best choice, Canada. Canada has been a very prominent choice for skilled workers and students even in times of the restrictions it had imposed to combat COVID-19.
