New requirement could cancel your Parent Visa of Australia

Making changes to any personal and contact details and failing to notify the Authorities could cancel your Parent Visa of Australia. Changes made to the online usernames and profiles also have to be notified to the Australian Authorities. 

The new requirement has been attached to the newly launched Temporary Sponsored Parent Visa. As per this new requirement, the Dept. of Home Affairs has to be notified at least two days before making any changes to one’s personal or contact details. These include changes to your name, phone number, address, email address, user name and online profile. 

Migration Experts are of the view that the new requirement is unreasonable and harsh. They believe that it is humanly not possible to always inform the DHA before making these changes. 

Visa holders not following this requirement will receive a Notice of Intention for cancellation of the Parent Visa. 

The new Parent Visa of Australia has been made effective from 1st July 2019. 

Mohd. Al-Khafaji, CE of the Federation of Ethnic Communities Council of Australia feels that the new requirement is very inconvenient. It leaves absolutely no scope of error for new Parent Visa holders. He says that the Govt. should create a welcome experience for families reuniting in Australia. Imposing harsh penalty such as deportation for a minor oversight is extremely harsh, especially for the elderly. 

Elderly parents are most likely to face the brunt of this requirement as not all of them are tech-savvy. Not all of them regularly use online platforms; even the ones they have created usernames and logins for. More often than not, they do not remember these login details and end up creating new ones. Notifying the Dept. of Home Affairs beforehand, each time is certainly not possible for these elderly parents. 

As per a Spokesperson of the DHA, the requirement has been introduced to ensure that the records held are correct. The DHA would be able to communicate with these Visa holders whenever required, as quoted by SBS News. 

15,000 visa places have been allocated for the new Parent Visa every year. The validity of the Parent Visa may be up to 5 years and can be renewed once. The visa fee for a 5-year Parent Visa is $10,000. The minimum income of the sponsoring children in Australia should be at least $83,454 to sponsor their parents.

Important updates regarding the Subclass 491 Visa of Australia

The Subclass 491 (Skilled Workers Regional Provisional) Visa will come into effect from 16th November 2019. Preparations for the same are in full swing by the Immigration Dept. of Australia. 

The Subclass 491 Visa aims to invite qualified and skilled workers to the Regional Areas of Australia for a specified period. This Visa will replace the current Subclass 489 Visa of Australia. 

16,000 Visa places have been allocated for the Subclass 491 Visa by the Dept. of Home Affairs. There are  500 occupations which have access to this visa category. 

Just like other Skilled Migration programs in Australia, the Subclass 491 will also be a points-tested Visa program. Highest scoring candidates of in-demand occupations will be invited to submit an Australia Visa application. Initially, the Subclass 491 will be granted for 3 years. Visa holders who complete the mandatory stay of 3 years in the Regional Areas can then proceed to file for the Subclass 191 PR Visa. 

Subclass 491 Visa holders will be allowed to change regional areas. They will also be allowed to switch occupations. However, they will not be allowed to move to other states or territories in Australia. Also, 491 Visa holders are barred from applying to any other Skilled Migration Programs for the first three years. 

The visa application fee for the Subclass 491 Visa is $4,045 for the primary applicant. The fee for the spouse and children are $2,025 and $1,010 respectively, as per SBS News.

Recent SkillSelect results show that more invitations are being issued to those scoring 85 points. 

Engineering, Accounting and IT are some of the high demand occupations in Australia. You would require a minimum of 85 to 95 points to get an invitation. 

It is becoming increasingly difficult for new migrants especially foreign students to obtain an ITA (Invitation to Apply). 

The last SkillSelect invitation round was held on 11th June. Here are the results of the same.

The Dept. of Home Affairs is currently facing visa applications backlog. This is forcing them to keep the invitation number to just 100, as quoted by SBS News. 

In May too, only 100 invitations were issued in the SkillSelect round. 

Australia currently is facing a backlog of 12,300 for the Skilled Independent Visa. For the Partner Visa, the backlog is around 80,000. 

The SkillSelect Invitation round invites candidates who have obtained the highest scores. If two candidates who have the same score, then the one who has lodged the EOI earlier is selected. 

To submit an Expression of Interest, you need to score at least 65 points. However, not many people scoring 65 points have been invited in the recent SkillSelect rounds. 

The number of invitations being issued in each round may differ depending on the number of applications that are being processed by the Dept. of Home Affairs.

Important changes to the BIIP Visas of Victoria, Australia

From 22nd July 2019, Victoria in Australia will start accepting nomination applications for the Business Innovation and Investor Program (BIIP). You do not need to wait to receive an invitation from Victoria. 

However, Victoria currently is not issuing any invitations. Those who have already lodged an EOI through SkillSelect but have not received an invitation from Victoria should directly submit a nomination application from 22nd July. You do not need to submit another EOI. 

From 22nd July onwards, here are the new nomination criteria for the BIIP Visas: 

  1. Applicants for the Subclass 188 Business Innovation Visa would need to score 80 points on the GSM points grid 
  1. Subclass 188 Visa applicants would need to commit at least 1 full-time employee in their primary business 
  1. Applicants proposing an export business would need to demonstrate that all export products are 100% manufactured in Victoria 
  1. Subclass 188 applicants would need to make an additional investment of $500,000 in Victoria during the provisional visa period 
  1. Subclass 188 Visa applicants would need to demonstrate access to $200,000 available for immigration purposes 

It is to be noted that applicants who have already received an invitation would not be subject to these changes, as per SBS News. 

The Skilled and Business Migration Program of Victoria will be launching a new online application system for Visa nomination on 29th July 2019. 

The new online system will: 

  1. Allow applicants to track their applications online 
  1. Allow applicants to access their accounts from multiple devices 
  1. Allow greater ease at managing client applications 

No nomination applications can be submitted through the “Live in Melbourne” website from 4 pm 24th July to 29th July 2019.

Update on the Australian Skilled Regional Visa transition 

No more invites for Australia Subclass 489 after 10 Sep

The Subclass 489 (Skilled Regional Provisional) Visa will soon be eliminated and replaced by the Subclass 491 Visa. The Subclass 491 Visa will be effective from 16th November 2019. 

10th September 2019 will be the last day for invitations to be issued for the Subclass 489 Visa. 

There are two categories under which invitations for the Subclass 489 are issued: 

  • Sponsorship by a state or territory in Australia 
  • Sponsorship by an eligible family member living in Australia 

The 10th September 2019 deadline will be applicable to both the above categories, as per SBS News. 

The last date to lodge an EOI (Expression of Interest) for the Subclass 489 Visa would also be 10th September 2019. 

The last day to submit a visa application for the Subclass489 for people who have been invited would be 15th November 2019. 

There is a 67day gap between the last invitation date and the last day for visa submission. This should no way prove to be a hindrance because normally SkillSelect invitations are only valid for 60 days. 

Australia will start accepting EOIs for the Subclass 491 Visa from 16th November 2019. 

States and Territories would also be able to nominate overseas workers from 16th November onwards. Invitations would also be issued after this date only.

Update on the Australian Skilled Regional Visa transition 

Never do this on a Student Visa in Australia

A Student Visa of Australia allows an international student to work for 40 hours per fortnight during a semester.  

The Condition 8105 of the Australian Migration Regulations 1994 states: 

  • The Student Visa holder should not commence any employment in Australia before their study course starts 
  • The Student Visa holder must not engage in any work for more than 40 hours a fortnight during a study session 

A fortnight implies a period of 14 days beginning on a Monday. 

However, a number of international students risk cancellation of their Student Visas due to breach of this Condition. Most of these international students were found to be working for Ola, Uber, or Taxi as drivers. Some were even working as delivery agents for food chains like Uber Eats. 

It has been noticed that international students often lose track of time while working for such employers. They, thereby, risk the cancellation of their Student Visas by the Dept. of Home Affairs due to violation of the Condition 8105. 

In the Verma vs Immigration Minister &Anor (2017) case, the Federal Circuit Court clarifies the “work” concept for Student Visa holders working for employers like Ola and Uber. 

Justice Young highlighted that when working for such ride-sharing services, work begins at the start of a student’s driving shift. It also includes the time waiting for a particular passenger on the time waiting in between passengers. Thus, any activity during this time like reading a book is included in the allowed 40 hours per fortnight limit. 

Hence, it is extremely important for Student Visa holder to be mindful of the number of hours that they are working every fortnight. In case of any suspicion, the Dept. of Home Affairs can ask for your driving activity record for Uber Australia. They may even obtain your salary record from ATO (Australian Taxation Office). 

 If you are found violating Condition 8105 and exceeding your work hours limit then you may be issued a Notice of Intention to Consider Cancellation from the DHA.

Update on the Australian Skilled Regional Visa transition

Australian Skilled Regional Visa

The Australian Skilled Regional Visas will commence from November this year. In a lead up to the same, Immigration Australia has announced more details on the implementation dates and transitional arrangements of the Subclass 491 and 494 Visas. 

Lodgement Deadlines 

10th September 2019 will be the last date to receiving an invite under the Subclass 489 (Provisional) Visa. The last date to submit a Visa application following the invite would be 15th November 2019. The last date to submit a Subclass 187 RSMS nomination or Visa would also be 15th November. Any RSMS Nominations which have not been finalized by 16th November 2019 would be withdrawn automatically. Only those nomination applications whose corresponding Visa applications have also been lodged would only be considered. 

There will be no changes to the Subclass 186 Employer Nomination Scheme. 

Definition of “Regional Area” 

The Immigration Dept. will release a list of postcodes which will help applicants determine if their area qualifies for Regional migration. 

Subclass 491 Visa (Skilled Work Regional Provisional) Visa 

Applicants would be able to submit an EOI for the Subclass 491 Visa from 16th November 2019. States and Territories in Australia would also be able to nominate and invite applicants from this date.  

The Subclass 491 Visa will replace the existing Subclass 489 Visa, as per SBS News. 

Subclass 494 (Skilled Employer Sponsored Regional Provisional) Visa 

From 16th November 2019, businesses in Australia would be able to nominate employees and lodge applications for the Subclass 494 Visas. These nomination applications should include evidence of Labour Market Testing. It should also contain advice from the RCB (Regional Certifying Body) that the market rate is acceptable for that particular area.  

Nominated applicants should be under 45 years of age and have a positive Skill Assessment. 

Pathway to Permanent Residence 

Subclass 491 and 494 Visa holders must complete a mandatory stay of 3 years in the Regional Areas to apply for the Subclass 191 (PR Skilled Regional) Visa. Applicants will also need to provide evidence that they have earned the minimum taxable income in these 3 years. They should also have complied with all the conditions of the Subclass 491 and 494 Visas. 

Revised GSM points-test 

The GSM points test will be revised on 16th November 2019. Applicants will now be able to earn additional points under the following: 

  1. Points for nomination by a state/territory  or sponsorship by a blood relative will be increased from 10 to 15 
  1. Points for a STEM Masters or PhD from an Australian Institute would be increased from 5 to 10  
  1. Point for Partner Skills would be increased from 5 to 10 
  1. 5 points will be given if the spouse/partner can demonstrate competent English 
  1. 10 points will be given to applicants who do not have a spouse/partner

Australia Working Holiday Visa changes are now effective

Australia has introduced a few changes to the Subclass 417 (Working Holiday) and Subclass 462 (Work and Holiday) Visas for the new program year. The changes have come into effect from 1st July 2019. 

Australia has expanded the WH program to include more countries. It has also reduced the amount of paperwork needed to obtain this Visa. 

Here are the changes to the Australia Working Holiday Visa: 

  1. New countries 

The Australia Working Holiday Visa is now available to citizens of Greece and Ecuador. Applicants who are between the ages of 18 and 30 can now apply for the Subclass 462 Visa. Eligible candidates should have completed at least 2 years of Undergraduate study. They will also need to provide a letter of support from their respective Govt. These applicants also need to provide evidence of functional English. 

  1. Increase in age limit 

Australia has increased the upper age limit for French citizens to 35 years for the Subclass 417 Visa. Canada and Ireland are the other two countries that enjoy a higher age cut-off. 

  1. Less paperwork 

Applicants who are citizens of Spain, Portugal, and Austria no longer need to provide a letter of support from their Govt. Applicants who are citizens of Vietnam, Turkey, Thailand, Singapore, and Indonesia can now submit their applications online, as per SBS News. 

  1. Visa extension for a third year 

Eligible applicants would now be able to apply for visa extension for a third year. In order to be eligible, applicants should have worked for at least 6 months in a regional area of Australia. This extension is applicable, however, only if you have obtained a second Subclass 417 or Subclass 462 Visa.

Australia immigration changes to watch out for beginning July 

 

State Sponsorship for QLD, Australia to open by July end

The State Sponsorship for Queensland is currently closed, but it is expected to open by July end. Both the Skilled and Business programs for state sponsorship are closed right now. 

The BSMQ (Business and Skilled Migration Queensland) has said it is working with various stakeholders in finalizing the programs for 2019-2020. As per the official website, applicants have been asked to not contact BSMQ in the meanwhile. It will make a formal announcement whenever it starts accepting nomination applications. 

Till the time BSMQ starts accepting applications, skilled and business applicants would not be able to submit their state sponsorship applications. Applications submitted before the BSMQ opens would not be considered. Before submitting an EOI, skilled applicants would need to make sure that their occupation is available on the new QSOL. This is applicable for both the Subclass 190 as well as Subclass 489 Visa applicants, as per the SMH. 

The BSMQ firmly believes in giving skilled migrants an opportunity to join the community and contribute to the state’s growing economy. The BSMQ nominates candidates whose occupation is in demand in Queensland. This allows both PR and provisional Visa holders to live and work in Queensland. 

Australia has launched the State Immigration Plans which allows states to sponsor skilled migration candidates. The states can nominate candidates under a wide range of occupations to address the local skill shortages. The State Immigration Plans specify the number of visas and the occupations under which State and Territory Governments can nominate applicants. 

The Business and Skilled Migration Queensland is the nominating agency for Queensland. In collaboration with the Dept. of Home Affairs, the BSMQ nominates skilled and business applicants who want to settle in the state. 

Applicants who are successful in obtaining a Queensland state sponsorship: 

  1. Have their Australia Visas processed on priority by the Dept. of Home Affairs 
  1. Get an extra 5 points for their Subclass 190 visa on the GSM points-test 
  1. Get an extra 10 points for their Subclass 489 Visa on the GSM points test 
  1. Get the right to work for any employer in Australia without being bound to any one employer
